Massachusetts.- Kratom possession, distribution and sales will become illegal in Massachusetts on August 28 under an order signed by the Massachusetts Department of Public Health commissioner.
The commissioner signed the order August 13, designating kratom as a Schedule I controlled substance under state law.
The new rules also allow municipalities to take enforcement action against licensed businesses that continue selling kratom. Local board of health and inspectional services officials may issue cease-and-desist notices and citations or suspend local licenses and permits.
Kratom is a plant native to Southeast Asia that contains psychoactive compounds, including mitragynine and 7-hydroxymitragynine. It is sold in forms including leaves, powder, extracts and drinks.
The Department of Public Health warns that kratom products can vary significantly in composition and potency. Reported unwanted effects include psychosis, seizures, constipation, sweating and other symptoms. Overdose can occur, particularly with highly potent synthetic products or when kratom is combined with other substances.
The department also warns that physical dependence, withdrawal or kratom use disorder may develop.
The order takes effect August 28, 2026, and may remain in effect through August 28, 2027.
